    Sammy Gyamfi, others arrive at Supreme Court to file NDC petition

    National Communications Officer of the National Democratic Congress (NDC), Sammy Gyamfi, and other members of the party’s legal team, have arrived at the premises of the Supreme Court to file the party’s petition against the results of the 2020 polls.

    It is believed that respected lawyers including Tsatsu Tsikata and Tony Lithur will be part of the legal team of the NDC.

    The NDC has described the election, which saw President Nana Akufo-Addo, emerging winner as ‘flawed and rigged’.

    Meanwhile, a statement from the party said the petition was filed pursuant to the party‘s audit of the 2020 Presidential results and extensive consultations with the National Executive Committee and Council of Elders of the party.

    The statement also noted that John Mahama shall be addressing the nation at 8:PM today on the petition filed and other related matters.

    The National Democratic Congress, wishes to inform the general public that at about 12PM this afternoon, the leader and Presidential Candidate of the party, H.E John Dramani Mahama, caused his lawyers to file a Petition in the Supreme Court of Ghana to challenge the 2020 Presidential Election Results Declaration by the Chairperson of the Electoral Commission of Ghana.

    The Petition was filed pursuant to the party‘s audit of the 2020 Presidential results and extensive consultations with the National Executive Committee and Council of Elders of the party.

    The Petition details serious violations of the 1992 Constitution by the Electoral Commission and its Chairperson and Returning Officer for the Presidential Election, Mrs. Jean Adukwei Mensa in the conduct of their constitutional and legal responsibilities. It seeks among others, a declaration from the Supreme Court to the effect that, the purported declaration of the results of the 2020 Presidential Election on the 9th day of December 2020 is unconstitutional, null and void and of no effect whatsoever.

    H.E John Dramani Mahama shall be addressing the nation at 8PM today on the petition filed and other related matters.

    The under-listed personalities have been assigned as Spokespersons on the matter and may be contacted by the media after the Petitioner’s address to the nation and throughout the hearing of the matter:

    Official: NDC heads to Supreme Court over 2020 elections

    The National Executive Committee (NEC) of the National Democratic Congress (NDC) has taken a firm decision to head to the Supreme Court to contest results of the December 7 elections.

    The decision was taken on Tuesday, December 29.

    “The NEC decided that the NDC will contest the results of the rigged elections in the Supreme Court and other appropriate fora,” a statement issued by General Secretary Johnson Asiedu Nketia after a NEC meeting announced.

    “In addition, the party will continue all legitimate actions, including protestations, to press home its demands for the government of President Akufo-Addo to enforce the rule of law and protect life and property in Ghana and, in particular, to take all necessary measures to bring to swift justice those responsible for the murders and injuries and destruction of properties before, during and in the aftermath of the general elections.”

    In previous media interactions, some leading members of the party hinted of the party’s plans to seek legal redress.

    Key amongst such persons were Rockson-Nelson Dafeamekpor, MP for South Dayi and Abraham Amaliba, legal team member of the party.

    Background

    Out of the 13,119,460 total valid votes cast in the recently-held 7 December 2020 polls, President Nana Addo Dankwa Akufo-Addo of the governing New Patriotic Party (NPP) polled 6,730,587 votes, representing 51.302 per cent.

    While former President John Dramani Mahama, candidate of the National Democratic Congress (NDC), polled 6,213,182 votes, representing 47.359 per cent.

    NDC Heads To The Supreme Court To Contest Results Of 2020 Election – Asiedu Nketia

    The General Secretary for the largest opposition National Democratic Congress (NDC), Johnson Asiedu Nketia has officially on Tuesday, 29th December 2020 issued a statement that his party will go to the Supreme Court to contest the results of the recently-conducted general elections.

    The National Executive Committee of the National Democratic Congress (NDC) in a meeting at the Ghana National Association Teachers (GNAT) Hall has decided to challenge the results of December 7, 2020 polls they consider to be “rigged” in the Supreme Court.

    In a statement signed by the NDC Chief Scribe, the party will in addition contest the “rigged” election results in other appropriate fora.

    The statement again read that the NDC will continue all legitimate actions, including protestations, to press home its demands for the government of President Akufo-Addo to enforce the rule of law and protect life and property in Ghana.

    “In addition, the party will continue all legitimate actions, including protestations, to press home its demands for the government of President Akufo-Addo to enforce the rule of law and protect life and property in Ghana and, in particular, to take all necessary measures to bring to swift justice those responsible for the murders and injuries and destruction of properties before, during and in the aftermath of the general election,” the statement read.

    “The NDC’s commitment to the upholding of the constitution and respect for human rights shall remain unshaken,” the statement adds.

    When will the petition be filed?

    It is not clear when the NDC will file its petition challenging the declaration by the EC, although some members of the party had indicated that it will be filed by Wednesday, December 30, 2020.

    As at 3:30 pm Tuesday, sources at the Supreme Court told Graphic Online that the NDC was yet to file its petition, reports Graphic Online’s Emmanuel Ebo Hawkson.

    Per Article 64(1) of the 1992 Constitution, a petition challenging the validity of the election of the President should be filed at the Supreme Court within 21 days after the declaration of the results by the EC.

    The EC declared the results on December 9 so technically the 21 one days elapses Wednesday, December 30, 2020.

    Format

    According to a new Supreme Court (Amendment) (No.2) Rules, 2016 (C.I. 99), only the declared winner of the election, in this case (President Akufo-Addo), and the EC can be respondents in the petition.

    Again, per the new rules, only Former President John Dramani Mahama, the Presidential Candidate of the NDC, can be the petitioner.

    This is a major departure from the 2013 presidential election petition filed by then-candidate Nana Addo Dankwa Akufo-Addo, which also had the New Patriotic Party (NPP) as a petitioner and the NDC being allowed to join as a respondent aside the Electoral Commission and the NDC’s presidential candidate, John Dramani Mahama.

    This means per the new rules no joinder application will be allowed.

    Another major shift in the new rules is that the Supreme Court will use 42 days to determine the petition.

    This was unlike the 2013 case in which the petition traveled more than eight months.

    Per Rule 69 C (4) of C.I. 99, the pre-trial of the petition shall be on the 10th day after the filing of the petition, with hearing commencing on the 15th day and ending on the 21st day respectively after the filing, while judgment will be on the 42nd day.

    The Member of Parliament for Sagnerigu Constituency in the Northern Region has hinted of his party’s decision to go to court to seek redress on the December 7 elections.

    Alhassan Bashir Fuseini, popularly known as Alhaji A.B.A Fuseini, said no one can force the National Democratic Congress (NDC) to go to court until they have gathered all their evidence.

    All the 106 National Democratic Congress (NDC) Members of Parliament in the Seventh Parliament of Ghana marched to the headquarters of the Electoral Commission (EC) on Tuesday, December 22.
    The march was to prevail on the EC to overturn its declaration of President Akufo-Addo as the winner of the 2020 elections.

    There has been a series of protests by NDC supporters across the country against the EC’s declaration of President Nana Addo Dankwa Akufo-Addo as the president-elect of Ghana after the December 7 polls.

    Member of Parliament for South Dayi Constituency in the Volta Region Rockson-Nelson Etse Kwami Dafeamekpor, who hinted of Tuesday’s march on Onua TV’s 100 Degrees on Monday, explained that the leadership of the party will not sit for the EC to take them for granted.

    When the host, Kwame Tutu, asked what next after the series of demonstrations by his party’s supporters, yet yielding no results, the NDC MP said, “you wait and see what will happen tomorrow”.

    Speaking on the issues on Onua TV‘s Maakye jointly hosted by Afia Tagor and Adwoa Konadu-Yiadom on Tuesday, Alhaji A.B.A Fuseini hinted in Twi that “we are going to court on 28th December. We are going to court”.

    He added: “We are walking to the EC office to register our protest and present a petition to the EC.”

    The former Northern Regional Minister said, “we are gathering our evidence and we are going to court on December 28 because we will not allow such stealing in the country.”

    The government has described as “false” claims by the main opposition John Dramani Mahama, National Democratic Congress (NDC) and its flag bearer John Dramani Mahama that they have won majority of parliamentary seats in the just ended December 7 polls.

    According to the government,John Dramani Mahama

    Addressing the media on Tuesday evening [8 Dec 2020], the presidential candidate of the NDC, Mr Mahama said the NDC’s analysis of the results show that the biggest opposition party has won the majority of seats in Parliament.

    “We thank the electorate for giving us a working majority in parliament; 140 seats in Parliament, which is a majority and no attempt should be made to subvert that.

    “I’ve looked at the results we’ve collated so far and I’m excited, I’m happy with the results; we won in 10 regions out of 16 and the Ghanaian people have expressed confidence in us,” Mr Mahama said.

    But reacting to this at a press conference few hours later, Information Minister Kojo Oppong Nkrumah said Mr Mahama’s claim is false.

    Mr Nkrumah said: “For the first time, a candidate, a presidential candidate is claiming his party has secured parliamentary majority.

    “That claim by the candidate to have won a parliamentary majority is false.

    “Anybody who has followed Ghana’s electoral process knows that we have returning officers at the 275 constituencies that is different from the returning officer for the presidential elections.

    “These returning officers collate the results and make a formal declaration of who has won the constituency.

    “The Ghanaian media is littered across all 275 constituencies and their collation centers. You are the ones reporting this election. If indeed anybody has won 140 in Parliament by now you will know.

    “So the claim by Mr Mahama that his party has won parliamentary majority is false…so it is important that at this point in time that claim be shot down so that the Ghanaian public, some of whom will be going to bed, the international community listening doesn’t get that idea that Mr Mahama’s party have won parliamentary majority.”

    If the statement ‘out of the abundance of the heart, the mouth speaketh’ applies in every case, then there is a special place in Nana Addo Dankwa Akufo-Addo ‘s heart for Nii Lante Vanderpuye, the National Democratic Congress (NDC) Parliamentary Candidate for Odododiodio.


    So much does he (Nana Akufo-Addo) think about him that at a rally to climax a campaign period that has seen him comb every nook and cranny of the country for votes, he could not resist the urge not to mention his name.

    A pretty awkward and perhaps funny moment was witnessed at the NPP’s last rally at Mantse Agbonaa in Accra as President Akufo-Addo introduced the NPP’s parliamentary candidate of the area as Nii Lante Vandepuye instead of Nii Lante Bannerman.

    “In Odododiodio, if you are voting for me, then you are also voting for Nii Lante Vanderpuye”, the president said as he held the hand of Nii Lante Bannerman.

    Having been notified that he had caused a blunder, President Akufo-Addo quickly mentioned Nii Lante Bannerman. Amid laughter, he apologized and urged the people to pick Bannerman over Vanderpuye.

    “I didn’t speak well at all. I have a made mistake. What am I going to do with Nii Lante Vanderpuye. I meant Nii Lante Bannerman and I want you all to vote him”, Nana Akufo-Addo said as the crowd cheered and applauded.

    President’s gaffe could be due to the similarity in the names of both candidates.

    The only point of departure as far as their names is concerned is the surname (Bannerman and Vanderpuye).

    Aside that, the name of Vanderpuye is easily recognized as he is more popular and is one of those NDC’s MPs who have been a thorn in the flesh of the government with their constant criticism.

    Some have also attributed the gaffe to fatigue.

    The two candidates have dominated the media space as they seek to represent a constituency that has a history of being closely contested and a flashpoint in every election year.

    Recently, supporters of the two parties clashed with dozens getting injured and properties being destroyed.

    Kojo Oppong Nkrumah Names NDC Kingpins Behind Recent Fake News

    Information Minister, Kojo Oppong Nkrumah has accused the opposition National Democratic Congress (NDC) of being the architects of fake news and videos against the ruling New Patriotic Party (NPP).

    A recent video making the rounds on social media which some political pundits have described as fake, indicates that President Akufo-Addo reportedly took an amount of $40,000 as a bribe.

    A second video also being circulated on social media however shows something different.

    According to the Managing Editor of the New Crusading Guide newspaper, Kweku Baako, that is the original and true reflection of what actually happened in 2016.

    Prior to this, there have been other fake news and videos all against the NPP and according to Kojo Oppong Nkrumah who doubles as the Member of Parliament for Ofoase Ayiribi, were all orchestrated by the NDC.

    Speaking in a one-on-one interview on Peace FM’s morning show ‘Kokrokoo’, he mentioned some names of NDC bigwigs who are allegedly behind such acts.

    The National Democratic Party on Monday, 23rd November, 2020 cautioned the NDC against what it claims to be the shedding of crocodile tears over the demise of former President Rawlings.

    According to the General Secretary of the NDP, when Jerry John Rawlings was alive, John Mahama and the NDC disrespected him and desperately wanted to silence him. And now that he is no more, they want to utilize his death to galvanize support for their failing political campaign ahead of the 2020 general elections.

    He said, “We are troubled that some of these same persons, upon the demise of President Rawlings, now seek to lead in mourning the man; they have begun to shed crocodile tears. They spent thousands of dollars to sponsor videos made in Washington DC by one Kelvin Taylor, who is tipped to be information Minister in the event of a Mahama comeback, to insult President Rawlings in words, some of which we dare not repeat, and posted them all over the world through Facebook, WhatsApp, and other social media platforms.

    Mr. Frimpong also accused Mahama and the NDC of endorsing the misdeeds of Kevin Taylor against Mr. and Mrs. Rawlings. He argued, “With the apparent endorsement of John Mahama and the NDC leadership, Kelvin Taylor said, and I quote, “Rawlings is a modern-day Judas and a hypocrite. He and his sleazy wife are greedy. He behaves as a lapdog to the NPP government and always kisses the ass of Nana Akufo-Addo anytime he gets the opportunity to speak about corruption.” He also went on to say and I quote, “JJ Rawlings is not God, he is bad Nationals and a modern-day Judas… and such a man does not even deserve to be a Statesman.” “JJ Rawlings is a coward… [you are] a hypocrite and a disgrace on the lap of a midget”.

    Per what we gathered the accident happened at New Edubiase formerly called the Adansi East district in the Ashanti Region.

    The accident involved a Sprinter Bus and a bus believed to VIP bus.

    A delegation from the family of late former president Jerry John Rawlings led by the former diplomat, Ambassador James Victor Gbeho, on Tuesday, November 17, 2020, paid a courtesy call to the flagbearer of the National Democratic Congress (NDC), John Dramani Mahama and the party leadership.


    The visit was to officially inform the opposition leader of the demise of the party founder, which occurred at the Korle Teaching Hospital on November 12.

    According to the former Diplomat, although the leadership of the party had already been informed of eventuality that had hit them, the family thought it appropriate and respectful, to fulfil what tradition demanded.

    “We have come here purposely and mainly to fulfil customary tradition of informing President Mahama of the sad passing away of our colleague and brother, the late former President Jerry John Rawlings .
    “We know that you have already received confirmation of the news of the fallen of the giant baobab tree in front of our house but all the same, we thought it appropriate and respectful to fulfil the tradition that we have as Ghanaians and as Africans, of informing H.E as possible,” Ambassador Victor Gbeho said.

    He continued: “At the moment, we are only informing those who need to be informed.”Rawlings family and Mahama

    Mr Mahama in response to the delegation said: “We understand the complexities of the situation considering that he belongs to his family and that he also belongs to the state because he was the former president and then he belongs to a party. And so there must be a mixes between the three interests to be able to give him a befitting send-off.”

    According to him, the party together with him, understand that as a former President, the state will take a leading role in whatever funeral arrangements that will take place and so they stand in readiness to pay their respect in every manner appropriate, knowing who their founder was.

    No one-week ceremony
    There will be no ceremony to mark the first week of the passing of former President, Jerry John Rawlings , his office has announced.


    The office of the late former president says such an event will not be held since Rawlings is from the Ewe ethnic group who do not observe such activities for the dead.

    Firebrand Communications officer of the largest opposition National Democratic Congress (NDC), Sammy Gyamfi has shared her worries while speaking Kumasi-based Kesben FM this morning.

    According to the young legal practitioner who also doubles as the Communications Officer of the party, there is a lot that needs to be done by the Chairman of the Electoral Commission, but she is simply not doing so.

    He shared that education that needs to go and is not encouraging and this can lead to low turnout as we are some few days to the elections. This in the long run can lead to spoiling ballot papers, wrongly thumb printing among others.

    The firebrand political figure shared that electoral education needs to go on and all this was captured by in the budget allocation for the elections but he is saddened by how things are been done by the currently Electoral Commission’s Chairperson .

    He concluded by saying that this will definitely be the last term of the chairperson since her work is not been done well after they win power.

    The current government has been branded by a section of Ghanaians including journalist for being intolerance. Accusations include the government aiming to win the upcoming December elections with violence.

    The media including investigative journalist Manasseh Azure have in comparison confessed that they felt safe under the opposition government NDC than the current government the NPP.

    Per observations and reports members of the National Democratic Congress(NDC), are arrested for little or no offense where as members of the governing NPP such as Hawa Koomson and Kennedy Agyapong walk freely for greater offenses.

    The arrest of four persons conducting research for the opposition National Democratic Congress, NDC, in the Upper Manya Krobo Constituency of the Eastern Region has heightened political tension in the area.

    The four were arrested Saturday November 14, 2020 by armed Police officers led by the District Police Commander John Yeboah while in a community administering questionnaires.

    They were, however, granted bail four hours after the intervention of the party executives.

    Police also impounded motorbikes which they were using to move around.

    Addressing the media on Sunday, Kwasi Lawer spokesperson for the Campaign team of the NDC in the Constituency questioned the basis for the arrest of their members conducting survey for the party.

    He said:

    just as any other organizations like the media, students and the Civil Societies conduct surveys, we in the NDC also have that same right to conduct a survey and that was exactly what we were doing before the needless arrest by the police. We want to ask the police , when did conducting a research or a survey and campaigning become a crime in Ghana?

    “The District Police Command who is said to be acting on the directives of the top NPP executives reluctantly granted our party faithfuls bail after several hours of being in police custody”

    ” the Police Command who is supposed to act professionally per the code of ethics of the service, has thrown the laws of the land to the dogs, forgetting that his allegiance is to the state and not the governing party”.

    He said the NPP unleashed thugs on their party faithfuls during the voters registration exercise but the local police failed to act which has emboldened them to fester similar intimidation tactics going into the main election, therefore demanding, that Police come out with a roadmap to ensure peaceful election on December 7.

    The Party, however, charged all members and sympathizers in the Upper Manya Krobo Constituency “to remain vigilant and be security conscious due to what we have seen in Akatawia, when our opponents brought cutlasses to intimate us during the voter registration.

    “We haven’t forgotten how some of our party faithfuls were unfairly transferred, some slapped and beaten at various polling stations by no less a person but the NPP MP Hon. Joseph Tetteh himself”.

    The NDC Parliamentary Candidate for Upper Manya Krobo, Bismark Tetteh said the NDC may be forced to retaliate the NPP if the Police cannot be a neutral arbiter .

    “NPP thinks they can only win this election through violence. We are ready for them.We are for peace of course we know we are winning so we don’t have issues to fight people of we are winning then we must ensure that there is peace however we are also ready for whoever wants to bring violence to Upper Manya”

    However , the Upper Manya Krobo NPP has been reacting to this development accusing the NDC of inciting the people under the guise of survey.

    “Yesterday some of their youth went to the villages precisely Odumata and they went there to ask the people whether if they vote for Hon Joe T and Nana Addo Dankwa Akufo Addo won’t there be a war and the people asked them are you here to campaign and cause confusion indeed the area became chaotic.

    “Police had the intelligence and went there so they brought the guys who disguised under conducting research to the police station to write their statement. I was there ,nobody detained them, NPP have no time to follow them with their fallacies” Philip Kwaku Mamphey a stalwart of the NPP in Upper Manya said.

    The Upper Manya Krobo Constituency is one of the hottest areas in this year’s election as the NDC pushes hard to recapture its long occupied seat snatched in 2016 by the incumbent NPP Member of Parliament Joseph Tetteh who is seeking reelection.

    The Asesewa District Police Commander John Yeboah was however unavailable to respond to allegations of bias levelled against him.

    These allegations suggest that some authorities of the Police force are in with the current government as they intimidate members of the opposition NDC.

    Ghana goes to the polls on December 7. The EC has promised a fair, transparent and peaceful election.

    The vigil is taking place at the Obra Spot at Kwame Nkrumah Interchange in Accra.

    Flagbearer of the NDC, John Dramani Mahama, his running-mate, Professor Naana Jane Opoku Agyemang, other party dignitaries, and some members of the Diplomatic Corp are expected to show up at the event.

    NDC’s communications member, Stephen Atubiga, in an inteview on Kofi Tv boldly disclosed that they are more than ready and prepared to steal the corps of Jerry Rawlings should the NPP decided to burry him.

    According to Stephen Atubiga, the NDC should rather be doing the burying and not the NPP. He added that if President Akufo-Addo buried Papa Jay under his his or even in his bedroom, they would still go ahead and steal the body and rebury him.
